mind your language.....i just wanted to get an update...there was a big momentum built around passing the i-485 provision and now we are postponing it till CIR....We are also changing lobbying firm....These are two significant changes. First, the initial promise made to members is not being delivered upon and second, we are changing a firm that we have utilized for a year. Are there some problems going on? May be, the firm ditched us.....Look, all these are questions going thru my head....That's why I posted the question....I am bold enuff to ask the questions, rather than sit back and blindly believe whatever is fed to me.....I do not own IV and I don't want to either....
Just a legitimate question amidst all the changes.....

The visa restrictions, Cap and rules for H1 and H4 all were framed to protect American jobs. If H4 is given work permit then there is a fear that one more job may be taken from the American people. I am not telling it is correct but everyone are in that situation. Also we cannot resolve all the issues. L2 can work H4 cannot work is discrepancy. But one person working in a home will not have any stress especially when there is kid. We have to consider this is an advantage

Background: I am on 7th year of H1B (7-10 year extension based on approved 140). My H1stamping is valid till 2010. Applied 485 on Aug 1st 2007. Did not apply for EAD/AP.
Loosing job in my company is becoming realistic scenario in near future(no predictions yet) so...
Scenario 1: If in next few weeks (before 180days or AC21) I have to change Jobs, Can my new employer just transfer H1B (since H1B was extended on approved 140 Hence the confusion) or do they have to go through PERM + 140 and then do H1B transfer ? What happens if my employer revoke 140 (based on which i had the H1 extension) Do I loose ability to transfer H1B?
Scenario 2: If after 180 days (from aug 1st) I have to change job (using AC21) ..can my H1 be transferred to another employer without having a labor / 140 or will the new employer have to go through PERM + 140 to transfer H1?
I understand EAD is an option so I will apply for EAD but looking at number of applications it may be months before I get EAD card.

Now if I want to go back to Company A, do I need to transfer my H1B again?

Hi,
I have my H1B from company A.Now I am planning to have H1 transfer to company B. I don't have a record of the experience letters(2000 - 2003) I submitted when I filed my H1b through company A.
Now when I am applying for H1 transfer from company B can I just submit the experince letters from 2004-2007 including the letter from company A so that they don't contradict with what I have submitted before??.
I would also be submitting my education evaluation,w2s,recent paystubs etc. The problem is only with my previous experience letters.
please let me know if this is okay or can there be a problem.Any help would be greatly appreciated. This is urgent for me!!!

you are half right, the country quota laws were put much earlier than the off shoring companies, but remember that the retrogression only started in the last 10 years when those companies came in the picture and skewed the lines .. that's ur cause and effect!
I am in software and would be satisfied with resticting this rule to the software field, but feasibility wise, rules won't get micro-tailored this way.
I always tell myself i shouldn't go on with the discussion, but here i go again..

Here's a one step way to quit.

Mirage..you are absolutely right...i paid 765$ as per old fees for I485,EAD,AP. the new fees for I485 is 1010$ and EAD,AP can be concurrently filed with no fees.also, since I485 is filed with new fees there will be no fees for renewals.so, basically 1010$ one time fee with the new fees structure and 765$+645$(EAD+AP) with every renewal every year.(if it becomes 2 years then for every 2 years).i wish i had paid thru new fees.this is completely unfair and big BS......

So if you can get a short term Schengen visa (the consulates are empty in the US FYI) visit some places in Europe as part of a layover (ironically cheaper to get 2 tickets instead of a transfer) and then travel to India. Skip duty free in Europe as it's price gouging.

I can understand the quality and committment of lawyers can make a huge difference especially in this unprecendented situation where all EB categories are made current now and now there is a rumour that it would be retrogressed back probably sometime next week with a new visa bulletin.
A lot of lawyers who are really committed and sincere to their client's clause: Getting them Green Card, are working overnight and over the weekend also so that their client can file I-485 ASAP and on the other hand few law firms are acting as slackers and not even responding to their client's emails.
Anyway, I am interested in knowing everyone's experience ( good or bad ) with law-firms and their recommendation.
My Own Case:-> I work for a multibillion dollar telecom company and joined this company almost 15 mos ago with a promise that they would start my GC immediately. Till Now, they have not yet file my labor. Their lawfirm is Larrabee http://www.larrabee.com/ in sanDiego. I don't have much experience with them as my application is still in my company's internal queue but based on the basis of my little experience, I would certainly not recommend them

The best example is applying for 485 during the latest visa bulletin fiasco. Everybody in the community had a hint that USCIS may only accept a few applications for July. On the friday(June 29) before Jul 2 my missing document reached Mr. Khanna's office. Since they had too many applications to handle, the staff did all-nighters and sent my paperwork Saturday afternoon. It reached USCIS Monday July 2 at 9:00 am. Such commitment and hardwork is unparalleled in my opinion.

I was also told that there is new law which requires that the PERM fees should be paid by the employer (around 5-6k). Most desi consultancies used to ask the employees to pony up the labor fees. wonder how this will affect the conversion process.
It is ILLEGAL for the foreign applicant to pay for the PERM fees or the I-140 fees or lawyer expenses pertaining to either steps. The Employer MUST bear all expenses for this process. If you have evidence of wrongdoing, pls report it to DOL.
We should not be supportive of such violations of law - as a group it is not in our best interests.
The foreign applicant may pay all I-485 related expenses - or a generous employer can cover those expenses too.

You will be surprised that even with the restrictions H1b cap will be reached but not in one day or one month but within an year as demand will be there. These restrictions will impact only Indian bodyshoppers who are running just by H1b. Though H1b will be costly if CIR in the same form is passed but Most of good companies will overcome. So if you want to relative number of gc then you need to increase Gc by atleast 50 to 100% from current level.
Well..if thats the case they seem to have gotten a bad deal cause even togh the H1B visas will increase - there is still the $5000 inc in fee with other restrictions on consulting, removal of dual intent plus the Sanders amendment that deals with layoffs - these conditions nullify whatever the inc in numbers is
