When a foreign national is admitted into the U.S., he or she is issued Form I-94 Arrival/Departure record. my EAD card expires soon.
I have no clue regarding its procedure to renewal it.

I dont have a drivers licence so what shd be my proof of address??

Hi, I have been noticing on .com that even after the mess-ups in Aug 08 when similar visa bulletin came out and uscis approved lots of cases from 06 ignoring people from 04 and 05, they are not approving cases in pd order even now (well not like before but still bad). I mean how can they approve sep 05 cases before all 03/2005 cases are approved especially if they are all pre-adj and ready (atleast most are). Even though technically anyone until oct 1, 2005 is eligible for visa number, Shouldn't they go in order? This is very unfair given you don't know when they might run out of numbers and TSC is snail paced doing 3-6 approvals a day atmost while NSC is doing tons a day :) Any comments?

Scenario:
Working on H1. Wife is on H4. Waiting for our EADs.
Planning to work for H1-GC sponsorer employer until (or I should say 6 months after) we get the GC.
I am running a website and am planning to sell the advertising space?
Q1: Can a H1 legally receive the money from website advertising on his/her website?
Q2: Can a H1 register DBA?
Q3: How about if H1 uses EAD, can then he register DBA and legally receive the money from website advertising? (I know once you use EAD your H1 becomes invalid).
Q4: I know I can register DBA in wife's name when she receive EAD? Is that the only option I have?
Please share your thoughts!

Hi,
The company I am working for is filing for GC.
They have posted an ad,and all the mandatory work is done.
HR up here have received some resumes for this ad.
After reviewing these resumes, attroney says they may have to place a new ad, as they have recieved a resume which qualifies the position from a local person.
I spoke to my manager and he says the same thing.He told me he did not even interview the local guy who applied.
Is this the only way out of this position. Please advise.

I heard that if the current state u work in State A , is not the same as the one labor was filed - State B , then it can trigger an RFE.
My Q is HOW frequent is this possibility ? Has anyone experienced this ? Also my PD WILL Be current next month and I filed AR 11 about 10 days ago . Will that impact ? I got my I-140 Approved (EB3 - Jan 2004) with Company A. Can i use the approval notice and get my H1B extended for 3 years from a different company ? Please advice as this will help me a lot.

One can contiue to stay using I-485 receipt without valid I-94. afasik I-797 can be used only if you filed H1 extention after you came back on parolee.
If a person travels on AP, he will get a new PAROLE I-94 which shows expiry date of 1 year from the day he entered on AP. Can the person stay in US AFTER that expiry date and continue working using a valid I-797?

AILA Liaison has been coordinating with USCIS to help achieve this outcome. USCIS has the means to independently verify these cases.

Can anyone throw some light on this query...
I presently work for a cap excempt employer and now looking for employer who could file for my h1b under cap subjected in the month of april witha start date of oct 2008.
I would like the new employer to file my visa in such a way that, i could still continue with my present full time job even after oct 2008. Based on what i have understood, i guess if the new employer files as "COncurrent H1b" then i can join him at my wish after oct 2008 provided new emplyer has not revoked my h1b. Am i right..???
Also ..how many concurrent h1b can i have at a time..???
I don't want to miss this year quota, so want to make sure i take all precaution to get h1b cleared.
Greatly apprecite inputs...

Need advice ...I am currently on H1 B.
six years back (on F-1) I started working 2 business days prior to my CPT started.... Unfortunately ... that meant I did work unauthorized for a couple of days. Now I am at a stage where I need to use CPT experience to apply for PERM. Would stating the actual start date on form 9089 (which happens to be 2 days prior to actual CPT start date listed on I 20) pose any future issues?
CAn I be granted lineancy (something like 245K) if in in future this lapse becomes evident to U S C I S. How seriously would this minor violation be treated?

Hi,
I had a question regarding the july bulletin where it was mentioned that Old fees is entertained for employment based petetions while family based it would be new fees for I485.
Mine was applied by my company on July 2nd with old fees and Spouse's was applied on August 3rd with old fee and was rejected! I-140 was approved on August 8th and applied in March 2007!
Did they confuse with family based and rejected for fees?
Spouse should also be employment based right!
Can somebody answer my question?
