I left the U.S on October 30 2009. My L.C. [Perm] had been filed on July 30 2009 and was recently approved.
My 6 year H1B expired on Feb 2 2010, with approximately 160 days available for recapture.
My company needs me to return to the US urgently and is wanting me to apply for a Business Visa.
Subsequently when I am in the U.S, they intend to file for I140 and then 7th year H1B
extension plus recapture time based on pending I140
Is this feasible? -- What impact would it have on my green card application process?

Can someone clarify my issue.
I applied for H1-b in 2008(I was in L1 when i applied).My employer never gave me my recipt number and i didnt even knw the status for a while ( though he said he applied without COS).Later he told it was applied with COS.
Later after numberous calls and mail he gave me a recipt number ,but the
status on USCIS website was "Notice Undelivered as of June 2008".
I could never find ,whether it was RFE or Approved status.I called up USCIS they said employer has to call to confirm the status.My employer said he will follow up with USCIS but he never did and he is absconding now .I cant reach him ,no phone,no mails.So i continued on L1.
Since my extension is coming up.I wanted to make sure my status hasnt changed because of this issue.
Has anyone faced this situation? Had that notice (undelivered) been an approval letter ,would that change my status though it was never accepted (Its undelivered as of Jun 2008)

I was under the impression that they send only one notice for each case and that too to the attorney.My attorney has send me a mail that he received the receipt notices and the original would have been sent to the employer.In case the employer has not received,he will send me a copy.
Do i need to have the original receipts.I have a valid L1 stamping and planning to travel early next month.I heard that i need to have atleast receipt notices if i dont have the AP approval by then.

Sorry for the cross posting.
My papers were sent on June 21st, but they were receipted only on June 27th. Turns out USCIS returned my $1000 for premium processing :(.
My lawyer said they talked to USCIS and USCIS asked them to re-file with proof of receipt.
Did anyone who filed in end June have their 140 premium processing returned?

It seems that the TSC is processing the applications in the alphabetical order of the state. The info is based on some chinese forum. I am not sure how true the info is.
Are there any one from New York/New Jersey who have already got the receipt numbers? I have filed from NY and no info yet on our I-485. BTW, I am a july 2nd filer.

I�m currently on H1B, I'm planning to go back to my country for an extended period.
Few queries
1) Can my employer keep my H1B open and show that the job is available for me? If so, for how long can employer do that?
I may go for six months, year or more, depending on circumstances.
2) If after a year a new H1B is filled, by the same employer (given that old H1B cannot be opened for long) will I be able to utilize the old quota or would have to file in new quota.
3) If I come back after a year, does the 6 year counter restarted? ie. the limit of working for six years on H1B.
4) If my employer cancels my H1B, and after six-months or a year, a different company files a petition for H1B, will the petition fall in old quota? Or will have to wait to be filed in new quota for that financial year?
If someone could answer my queries and help me decide, it will be very helpful.

My EAD was about to expire in 4 months. I'm going to apply for the renewal. Can I keep working if the application is pending?
You can work as long as the EAD is valid. If you meant to ask if you can legally work while your old EAD has expired and your new EAD is pending, the answer is NO.
One more thing, the USCIS is required by law to make decision on your EAD application withing 90 days upon receiving your application. But someone didn't get that within 90 days. That casused problem bacause you can only apply for renewal of your EAD if it is 90 days or less before your old EAD will expire.
