Lawsuit will not help you. See AILA lawsuit for Visa Bulletin. USCIS did not even negotiate with AILA and chose to negotitate with IV. So you need to learn from it.
AILA now feels defeated because they could not show themselves as the protector of this community. If you see the lawsuit text by AILF, it clearly asks for money for lawyer fees, but does not asks for moeny for Medical exam and mental agony. So if you are going to trust your lawyers to help you, then good luck.
By the way, your Indian lawyer I dont know the name, sued DOL once and lost.
Secondly, how are you going to pay for the lawsuit? People here dont even want to pay $20 and you will need 20K or more for a lawsuit. Do you think you can raise that much?

Is this an estimate for EB or for all green card applications? Because I absolutely do not believe this is the number. There is just no about H1Bs issued to produce this number.
It was the figure that the Kauffman Report found about a month ago when studying the potential for Reverse Brain Drain amongst other things. It as accurate a number that you will find.
Remember, this is many years of cumulative build up of temporary work visas transferring to permanent residency path

I was in a similar boat as you when i filed my I485. I was forced to file 140 premium by itself as they stopped accepting starting july 2 07. So we shipped 140 on 29th june 07.On 5th july 07 my attorney shipped 485 with a FedEx acknowledgement of 140 doc acceptance and entire photo copy set of 140 documents

Very true, this is a place for Great Ideas........Thank you for that info. I was not visiting the forums regularly then, and the only time I saw it was when IV core was already supporting it and encouraging everyone to do it. I have seen many great ideas on the forums.

I am EB-3 ROW PD 2007 Aug. Reading all the Eb-3 I people's angry, I started to wonder what's gonna happen to the EB-3 ROW. Seems like if lots of Eb3-I change to EB2-I , They will probably eat up all the Spillover from Eb1, EB2 ROW from now on. That makes EB-3 ROW and EB-3 I become the same boat.
Is it what gonna happened?
All Indians and Chinese will file only EB2 now onwards:D
The problem is with past filings how to convert them to EB2.

There are a lot of folks speculating that dates might move back, but honestly it does not make sense. My interpretation is dates will move faster.
Moving "back" implies directionality, whereas moving "faster" implies speed - these two are as unalike as chalk and cheese. How does your interpretation refute those speculations? :)

As I was explained SSA do not classify Economic Stimumus Package as a Federal Benefit. For them Federal benefit is a recurring payment of certain amount and the Stimulus package is just one off.
Also, we should try and get our message across to IRS about dependents who can not have SSN due to the nature of visas issued (H4). IRS should update their system so that if first person filing the return has valid SSN, payment should be calculated as it would be if everyone has SSN. This would be lot more easy then issuing SSN and then filing 2008 returns with those SSNs.
Any thoughts/ feedback?

All law firms hired by the employer will only respond or react to employer and not to the employee. Fragomen is very conservative (not 100% ethical) and will not take any chances with GC processing. Employers will always take the law firm's adivice because they dont want to take any risk either. Fragomen represent almost all of the fortune 100 companies, all of BIG4's, BIG 3's and all major consulting firms.
If you (personally) hire Fragomen directly they will respond to all your queries in timely fashion. You will not talk to the lawyer at all. You will only talk to the paralegal. This is the problem with all big law firms.
Again, the prestige of the law firm you hire does not have anything do with your application.

I have been to the indian consulate couple of times and what I have seen so far is that people staying in the US take the consulate officers for granted.
People take the token and start filling up the form in the consulate itself, they will be at the window and will be pasting photograph or filling up the form itself on the counter.
I think the consulate officer should ask people that will you behave the same way at an US consulate??
People become impatient just waiting for 10 minutes as if they entire indian consulate has been waiting for them to show up at the office.
The way we Indians behave boarding a flight in US, the same does not happen in India. The way we behave with the consulate officers at Indian consulate does not happen at the US consulate. Why do not the same people trying filling up the form at the US consulate or try pasting photograph and even run to grab the original when they are at an US consulate.

I absolutely agree with this. All replies sound similar to me and concerned more about the illegal immigrant population. I think you will hardly find the words 'legal', 'high qualified' etc. As soon as they see/hear an immigrant, do they immediately start thinking illegal ?! I think we need to create more awareness that we exist. We need help from the media.

i-140 has been previoulsy approved. I was laid off but my original employer agreed to give me evl, but with the way the economy is going they are not doing well.
I have another employer which I am working now with.
How likely is to get an approval (or an rfe for paystubs?) before 180 days.

Bush is going back to the Capitol hill next week to push for immigration reform. He is hell bent on signing a CIR bill no matter what and Kennedy and durbin know that this there best chance to give amnesty to illegals and screew us Legals EB so this bill is going to be introduced and will pass for sure

And this new caste system of the DONOR forum which basically says screw you to everyone who has spent time, money or effort on IV and completely goes against the "Change for fairness and Justice" mumbo jumbo is a step in the right direction, IV needs to give way to an actual movement that actually does something and this DONOR forum concept will certainly go a long way in the marginalization of this site and community.
I completely understand what chaanakya is saying and I have a similar opinion. I understand the concept of "Donor" form and it exclusivity of information if you donate. If I question about the concept, I know I will be put down and if IV wants to move in that direction to reach the goals then so be it. So let me spare you from typing anything against my opinion. The only thing I would want to know is who is the "CORE" of IV now ? I vaguely remember it was up in the website somewhere when I joined in 2006. I don't see it anymore.
