Should we include an explanation of why we need the AP? When you e-file, there is no way we can fill in this information online.
... and prepared the following documents to be send:
-Copy of a e-filed I-131 receipt (.pdf, received right after submission, credit card payment reflected)
-Copy of Notice of Action for e-filed I-131 (received from USCIS, paper)
-Copy of I-485 receipt
-Copy of last Advance Parole
-2 photographs.
I hope this is what is required as supplemental docs.

Please don't shoot me for these thoughts, but please consider it only for sake of discussion.
Now that CIR is defeated again for nth time, We really need to consider rethinking about our stratergy,
I guess we are about 15K membership and if we include spouse and take a guess every one in five has dependent kid to join (wild gusstimate) we come close 35-40K approximately.
most of us are legal and we should not having any issue in getting Green card with current law only if backlog is cleared and we recapture visa numbers.
to recapture visa numbers we don't need any legislative reform AC-21 does apply,
We need to spend more energy in researching possibility of recapturing 90K visas and we will be done,
I really don't think we have strength and will power to fight legislation change along with illegals for most controversial subject.

u cannot roll into a roth directly. u have to roll into a regular ira and then to a roth.
but the earlier statement made sense.. dont withdraw immidiately..wait till the next yr and then withdraw from ira..so ur taxes will be 10% penalty and ur tax rate at that time...which will depend on the value of ur 401k.
so if make 80k now and are in the 25% bracket and u have 80k in 401k then u ll have to pay taxes equivalent to the 25% bracket.
but if u make 80k and have 20k in 401k then u r bracket will be the lowest one.

The word on the street is that the Cantwell amendment is not a part of the list of amendments that are currently floating around in Senate offices. There are 20 of them.
Even Bernie Sanders has one more coming (Yes, it is related to H1B). But Cantwell amendment is not there in the list of 20.

Just to clarify. You say that "a person with an MBA plus a 4 year bachelors from a US univ. will be exempt" but you don't really need the 4 year bachelors from a US university. The MBA from a U.S. university is enough to be exempt, even if your bachelor degree is from outside the U.S.
You are right. I typed it wrong. I really meant to say "4 years of bachelors from anywhere (which is equivalent to a US bachelors degree)". I was making the point about four years because some non-us bachelors degrees are 3 years, and they do not accept 3 years + masters as equivalent to US bachelors + masters as the number of years of schooling would be one year less.

H1b Transfer from IT to Marketing.

First THANKS to all for the fantastic information and help on this forum !
I have a H1 B based on IT ( Software Engineer).
I have already completed 6 years in the US, but I have three year extension till 2010 based on my labour pending for over 1 year.
I am not very keen about Green Card - But I wanted to change my job to Marketing for an insurance company (better pay and it is a role I like).
My questions are :
1) Can I transfer my H1 to do Markeing for the insurance company ( the job profiles are going to be different as my current job is in software) ?
2) Since I am on a three year extension based on my current Labor will it be an issue to transfer to the new company ? ( The new company is willing to transfer but is not willing to file a new H1).
Your advice is much appreciated.

Update: subsequent to the change in deadline we have redoubled our volunteer efforts in Northern California from once a week volunteer work to twice a week, volunteers on the ground effort. this effort entals that volunteers actively approach High-skilled legal immigrants for support for this admin fix campaign.
We are excited about this and are getting more traction as more people hear about this. The best way to motivate others is to do it yourself.
PS: the number of letter on the first page are understated. Abhijit and Digital have updated numbers. Growing by the week.

I had FREE company attorney but decided to file 485 etc. myself & it was so much better. You can easily do 140-485 etc yourself. Call me & I will tell you.
If at all use an attorney for PERM. In my situation, even that was screwed up & I had to do that myself.
It is high time, all of us capable of handling complex viral equations, do this simple job , spread the knowledge , save $$$ & contribute some savings to IV

I am tired of my company lawyers. They did not file my 485 when my PD became current in June bulletin. I gave all the documents required. I missed an opportunity big time. Even now they are not responding when i ask them when will they file my application. After reading the msgs posted in this forum i am confident that i can do 485 myself. What is your # that i can call in case i have any qs?

I have been thinking about whether to attend the rally or not from past few weeks. Attending the rally would require me to take a day off. Finally today without thinking twice I just went to my manager asked if I can take day off on 9/18 instead compensate the work in the following saturday. It was approved and I am attending the rally on 9/18!
I am feeling so good now.
Also, I live in DC area and can help if somebody needs to be picked from airport to the rally and drop them back if needed.
Hope to see thousands on 9/18th...

I flew Air France several years ago.
Had a bad experience. They had not issued a Paris-Delhi boarding pass to me in Atlanta. They said that I would have to get that boarding pass in Paris itself.
In Paris- they refused to give me the boarding pass- stating the flight was overbooked and that I am checking in 'late'. Acknowledged that the boarding agent was wrong in Atlanta. Bumped me to the next flight several hours later.
They have lost all my business since then. I have not flown Air France since then (and likely never will)

The initiative and effort you and other administrators doing at Immigration voice is commendable. As I have taken up new job only recently i am not able to make it for the advocacy day at Washington. I entered US on H4. Then applied for H1 for software job. worked for 2 months last yr and then went for maternity leave.
Now I started working again and I still have to go for stamping.
I have completed CPA and I would like to move to an accounting firm ( they have to file my H1 transfer with accounting domain).
Is this going to cause any problem during H1 transfer or stamping??
