People with EB3 applications should be allowed to port. But these should be EB3 applications which were genuinely applied and not substitute labor which opened during July 2007 fiasco.
Because a EB3 application with substitute labor in July 2007 has a priority date of 2002,2003,2004,2005 or even 2006. Where as a genuinely applied Eb2 prior to that, had the qualifications / job requirements before July 2007 and they are still waiting.
USCIS should realize their mistake in 2007, it encouraged a pay to play scheme, which is putting genuine people at great disadvantage.
Porting like any option was started with a good intention, but because of loop holes it has lost its meaning. There are people who landed in this country during the July 2007 fiasco, paid for the labor and have green cards in their hands now.
Or at least provide the same level of stringent requirements to port like (EB2-->EB1) . Technically a EB3 can port to EB1 also, but porting to EB2 is easier. That way Eb3's can consume Eb1 number and stop spill over to Eb2.
L1A is another one, where people qualify as global project managers with very minimal effort, could have less experience than a EB3 or in some cases they have reported to people in EB3 queue here from 2002 and are ahead of the EB3 within 6 months.

My hearty congratulations to all the "LEGAL" workers who can file the 485 on July 1. Also to those who now have some hope in "LEGAL" process.
I consider this movement as a lottery to people who came here legally and had the patience to go through the painstaking process.
Moving on I think we need to understand the following aspects:
1. Implication on H1 B requirement / extension during this process
2. Impact on Travel to home country during this process
3. Processing timeline of recurring EAD and Green Card
My views are that due to enormous amount of applications coming in this and next month 485 department will be over allocated and we will certainly see a back log moving from "priority dates" to actually getting the EAD and other docs. So it might actaully result in a year - year long wait just for getting EAD.
I am not also clear on when can travel back and forth to India with 485 pending.Finally do I need H1 B when I have EAD or not.
Hope this forum has many people with these questions now.
But again this is huge day for immigrants especially Indians as we were the most backlogged in the whole world. Make sure you book medical appointments as there going to be a bombadment for these requests.

Please stays away from Syed H Simin PC law firm. They don't answer calls, the receptionist or the front desk phone operator is very rude. Most of them who answer phone calls have a heavy accent , don't know the current immigration procedures or law but still they try to answer your questions. Most of the time they put your call on hold for 15+ mins and hang up on you. Very frustating and totally unprofessional. I wouldn't want to hire them even if they provide service at no charge.
Only 3 people in this firm know how to talk politely and answer your question properly, and they are the actual attorneys. The rest of them in the law office think that they are the DOS chief :) You won't find such kind of people even in a 99c store :D

Certainly Canada is much much better option. Wish people had talked about it 10 years ago. So for those who just came to America or those who are deciding where to go to work or to school, Canada should be the first choice. You will actually have more flexibility being a Canadian than American.

I can pitch in for this cause. But as others mentioned, we need to make sure what we are getting for the money and when. We can also ask for break down of charges for the money they are asking. How about involving the CIS Ombudsman and definitely GAO.

Is this true for Consular Processing applications as well ? I thought CPs are filed at the local US consulate (Mumbai in our case). Additionally, I have a question about I-485 - CP filing and retrogression. Once we file the 485, does the CP get stuck in case there is retrogression in a few months time or is it that once we have applied the process keeps going ? Thanks in advance for the information.

My friend did the same thing in 2005 and he was in india 2 days before his interview in the mumbai consulate and dates retrogressed and they cancelled his interview and had to come back...since he did not file for I-485 he did not get his ead and is still stuck in retrogression untill now.
I had chosen the option of CP in my I-140 application but now i am going to file AC21 to change that to adjustment of status so i can take advantage of EAD and AP..The dates are surely going to retrogresss severly in Sept and thats not enough time to get an interview (min 3 months) in an embassy abroad..

As I was explained SSA do not classify Economic Stimumus Package as a Federal Benefit. For them Federal benefit is a recurring payment of certain amount and the Stimulus package is just one off.
Also, we should try and get our message across to IRS about dependents who can not have SSN due to the nature of visas issued (H4). IRS should update their system so that if first person filing the return has valid SSN, payment should be calculated as it would be if everyone has SSN. This would be lot more easy then issuing SSN and then filing 2008 returns with those SSNs.
Any thoughts/ feedback?

The total number of applicants from other countries can be derived from roughly estimating number if H1 holders, adjusting for Indians and Chinese, and then dividing by 2 (50% of H1Bs never end up getting a green card), and then multiplying by 2 to adjust for derivatives. The bottom line - there are visas available in EB2 ROW and EB1 categories (which are current, meaning, undersubscribed), that are getting redistributed to EB3 ROW. This is why EB3 in total is using more than its share of 140,000 EBs. In fact, I believe the dates will be moving pretty fast on EB3 ROW, it will probably get all current in a couple of years.

Well I filed under Rest of World" and EB2 back in August of 2006 when it was current for me (it’s always been current for me since then). I filed both my I-140 and I-485 together. I have done the fingerprinting etc and even replied to a RFE for my I-140 (well my company did). On June 1st I got my company to submit an "out of processing time" request which gives USCIS 45 days to come back with a decision or reason for not approving it. Now after all this fiasco my lawyer is telling me that my I-140 will continue as per usual (since it's not affected by all this) but my I-485 will not be approved until after October 1st. I don't agree with him, I believe part of the 60,000 visa numbers have been allocated to those that are pending and current (so they haven't been approved but have already been allocated). Does anyone agree or disagree?

To pbojja, if you think being concerned about fraud desi companies and highlighting issues we can resolve easily (like English classes) is being disrespectful to one's fellow country men/women, then I must not have put forward my point clearly and I apologize for that. I never said that only English speaking skills were required to be a good professional. However, they are important tools for effective communication. Not every desi IT professional in the U.S. is a developer and is in roles which do require good English speaking skills. Anyway, I didn't mean to be disrespectful to anyone.

I got approval email too. It cant be sheer luck that so many people are getting the approvals when it was taking 3 months as per their published processing times. Looks to me they just want to give 1 yr EAD to as many as possible. Good way to make money in recession year.
It was general observation that Paper Based EAD is getting approved very fast. We have quickest approval in only 18 days (http://immigrationvoice.org/forum/showthread.php?p=250677#post250677). And this was reported a month ago (on 05/23/2008).
So I think it is their speed - it has nothing to do with intention to give 1 year EAD. On the avarage, people are getting EAD in 25 days.
Myself went ahead with e-filing (this takes 50 days). My FP is scheduled after 5 weeks of notice date (http://immigrationvoice.org/forum/showthread.php?t=18737). For E-filing, they have different process,which has not changed in last two months.
