I work for a big company in the SV and I know at least 100+ Indians and Chinese there, but when I showed up in the San Jose rally I didn't see any of them.

That hurts to see so many people using IV for tracking receipts on the day of the rally but not participating in the struggle IV is putting up just for them!!
But know what I think as members we have really considered all of them as one..! I mean.. we should have given special attention to DC and the neighbouring states to fetch in max people.. 'coz we can depend on them for proximity..! we have majorly focussed on getting people from various states..well that again paid off .. 'coz news articles particularly mentioned people flew in from states as far as CA etc..
We cannot consider a person from texas or seattle to be the same as one in DC / VA .. Its definitely hard to convince to attend a rally .. how can we convince to take a day/2 off and travel leaving family and rest !!

People think best in their native language, that�s why Japanese, Chinese, Americans or the Europeans progressed faster with all the challenges. I think India should give opportunity for every language not just Hindi and English to go maximize once potential. For historical reasons I think every Indian has the duty to preserve all our languages and heritage. Instead of confusing people with mandates, we should have more options. On personal note I like Tamil even though I am not a tamilian, because it is the only international, oldest living and a classical language from India.

SEC. 406. VISAS FOR INDIVIDUALS WITH ADVANCED DEGREES.
(a) Aliens With Certain Advanced Degrees Not Subject to Numerical Limitations on Employment Based Immigrants-
(1) IN GENERAL- Section 201(b)(1) (8 U.S.C. 1151(b)(1)) is amended by adding at the end the following:
`(F) Aliens who have earned an advanced degree in science, technology, engineering, or math and have been working in a related field in the United States under a nonimmigrant visa during the 3-year period preceding their application for an immigrant visa under section 203(b).
`(G) Aliens described in subparagraph (A) or (B) of section 203(b)(1)(A) or who have received a national interest waiver under section 203(b)(2)(B).
`(H) The spouse and minor children of an alien who is admitted as an employment-based immigrant under section 203(b).'.
(2) APPLICABILITY- The amendment made by paragraph (1) shall apply to any visa application--
(A) pending on the date of the enactment of this Act; or
(B) filed on or after such date of enactment.
(b) Labor Certification- Section 212(a)(5)(A)(ii) (8 U.S.C. 1182(a)(5)(A)(ii)) is amended--
(1) in subclause (I), by striking `or' at the end;
(2) in subclause (II), by striking the period at the end and inserting `; or'; and
(3) by adding at the end the following:
`(III) has an advanced degree in the sciences, technology, engineering, or mathematics from an accredited university in the United States and is employed in a field related to such degree.'.
(c) Temporary Workers- Section 214(g) (8 U.S.C. 1184(g)) is amended--
(1) in paragraph (1)--
(A) by striking `(beginning with fiscal year 1992)'; and
(B) in subparagraph (A)--
(i) in clause (vii), by striking `each succeeding fiscal year; or' and inserting `each of fiscal years 2004, 2005, and 2006;'; and
(ii) by adding after clause (vii) the following:
`(viii) 115,000 in the first fiscal year beginning after the date of the enactment of this clause; and
`(ix) the number calculated under paragraph (9) in each fiscal year after the year described in clause (viii); or';
(2) in paragraph (5)--
(A) in subparagraph (B), by striking `or' at the end;
(B) in subparagraph (C), by striking the period at the end and inserting `; or'; and
(C) by adding at the end the following:
`(D) has earned an advanced degree in science, technology, engineering, or math.';
(3) by redesignating paragraphs (9), (10), and (11) as paragraphs (10), (11), and (12), respectively; and
(4) by inserting after paragraph (8) the following:
`(9) If the numerical limitation in paragraph (1)(A)--
`(A) is reached during a given fiscal year, the numerical limitation under paragraph (1)(A)(ix) for the subsequent fiscal year shall be equal to 120 percent of the numerical limitation of the given fiscal year; or
`(B) is not reached during a given fiscal year, the numerical limitation under paragraph (1)(A)(ix) for the subsequent fiscal year shall be equal to the numerical limitation of the given fiscal year.'.
(d) Applicability- The amendment made by subsection (c)(2) shall apply to any visa application--
(1) pending on the date of the enactment of this Act; or
(2) filed on or after such date of enactment.

EB3 vs EB2 classifications depend on Job Description ie the description and education, experience requirement given at the labor certification stage.
You can get labor certification which would satisfy EB2 class requirements and apply under EB3 for I140 .... but not the other way around. ...
That means starting from scratch with PERM with a new Labor... loosing PD and back to square one ... obviously not worth it
PD is not lost if you crossed I-140 stage (got an approval) on the older application.

Free math turoring, free SAT preperation classes, you get the idea....
Good idea, do something constructive and get media attention. This solves multiple purposes, media attention, best use of time, and would also convey a positive message.

Well...I am one of us stuck in EB3. I do qualify for EB2 but my employer choose to file it under EB3. I recently invoked AC21 and moved over to a new employer on my EAD. Is there a way I can ask my new employer if they can file new I140 under EB2 and change my category to EB2?

Just reporting what I saw on CNN. During the Sen. McCain interview with Judy Judy Woodruff & Richard Stengel, Richard asked something like - what about the green cards for the highly skilled immigrants educated by American Universities. To this Sen. McCain replied implying - they should be given green cards sooner, I am not sure if they could be given automatic green cards but the process should be faster.....
He said it not exactly in these words but implying something to that effect. They were suppose to ask Sen. Obama the exact same questions. Did anyone see Sen. Obama's answer to the question about green card for high skilled immigrants from Richard Stengel? Just curious....

Appu, what abt labor cert? Does this advanced degree-holder still have to go thru labor cert? If yes, then the person with advanced degree but no experience has no advantage.

Just based on the definition given by DOL I decided Level III and Level IV to be EB2. Besides I am EB2 and my wage level is Level IV. I agree it is hard to conclude the cat based on wage level, I saw there were some Senior welders in Level III as well as Vice presidents of the companies. Quite a contradiction isn't it!!
I think Level indicates the Step within the existing Job Title. For example, a Senior Programmer Analyst could have a level 2 or 3 but an Entry level Project Manager could have a level 1 or 2. I think one would have to use a combination of Level and SOC Code.
