How is posible to get a SSN non-work to get Economic Stimulus Payment if you didn't work. How can you make tax return without to work. ?? Sorry for all this question but I really don't understand. But i'm shure that you will be very nice and you will explain me how it's work.

Well...I am one of us stuck in EB3. I do qualify for EB2 but my employer choose to file it under EB3. I recently invoked AC21 and moved over to a new employer on my EAD. Is there a way I can ask my new employer if they can file new I140 under EB2 and change my category to EB2?

Excellent response. I have been a silent admirer of IV for some time. IV has represented the aspirations of all the EB applicants. people should understand that the US allotment of visas to foreign Nationals is only based on what is fair for the country (US). It does not matter to them to what country the applicant belongs but what matters is the qualifications and their benefit to the advancement of the US. I am appauled to see some of the members racheting up this irrational discussion about the spillovers when DOS clearly stated recently what the intent of the law was. the sooner they get over this issue, the better for them and for every one on the forum as the existing rules will NOT change regarding the spillover. we have to concentrate our efforts on how we can improve conditions for every body affected by this retroression. efforts aimed at one category and that too one country will almost certainy fail. I am also shocked to see a few EB3 I expressing anger over dates moving for EB2. personally if I see a person from my country getting his visa approved, then I would feel very happy for him even if I am waiting for some time. I know it will be difficult, but atleast spare some joy for your country men and women who are getting some well deserved relief after such a long wait. one of my old friends told me once "if you have a friend from India, don't rely on him to help you, because you will not get much help moreover some people will only try to pull you down, but if you take people from other countries, it is exactly the opposite as they try to help each other in every possible way". I agree that it is very distressing for every one that the dates are retrogressed, but now that EB2 has moved, all of a sudden some people woke up from a deep sleep and started making these arguments that have no legal basis. None of these people expressed their anger when EB3 ROW was being preferred over more qualified EB2 I and C and making EB2 unavailable. I know a lot of people from EB2 protested at this wrong interpretation of the law, but I don't remember anyone ever criticizing IV for not taking up their cause even though we knew all along that spillover from EB1 to EB2 retrogressed countries was the right interpretation of the law. now some people are asking IV to take up an issue that is straight forward illegal as was clearly explained by DOS in a recent bulletin. instead of wasting time and efforts on such futile suggestions, people should concentrate on making some constructive effort along with IV helping every one involved in retrogression.

I think it comes from Federal DOL. If your annual salary is below the salary DOL considers minimum then getting the "prevailing wagge info" from DOL helps to make sure your labor is not denied on basis of salary. If your salary is well above DOL's minimum wage then it not a must document.
I say this from what I remeber and my email trace shows me. But keep in mind for me this happened 6 years back so things might have changed.
I dont know how much of of those 6 months FDBL took and how much DOL.
However it makes sense to ask FDBL to keep yor other applications/ documents ready so when they hear back from DOL, your application is filed within a week or so. Ask them to give you list of all documents (birth date cert, university mark lists , referal letters etc that they will need in order to file your labor and 485 ) Sometimes coming up with those doecuments also takes a lot of time. May be you can get them ready while DOL responds.
I had been shy and did not follow through with them becuase I didnt want to be "pushy".
But I learned my lesson in GC that you muust followup on your application not by being "pushy" but politely and persistantly.
Having good relationship with your HR/ legal and manager is very crucial. As FDBL responds well to such authority figures.

European carriers are not that friendly to indian flyers. if you have a choice, try to avoid them.
Never had a problem with KLM and BA. Got stuck in amsterdam for 36 hours, the airline got us all transit visa, a kit containing basic toiletries and night clothes. put us up in real nice rooms at the Sheraton, and gave us lunch and dinner vouchers to use at any restaurant on the airport.

I have a H1b with Company A. It expires in Nov 08.
A couple of months ago I joined company B and they transferred my H1B.
Now if I want to go back to Company A, do I need to transfer my H1B again?

I want to thank this european who got his greencard 2 weeks back but still attended the rally. There may be more heroes like this. I was in a group of people when we spoke to him, didnt catch his name as i was encouraging bypassers to honk their cars to support our cause.
He is over 6 foot, in immigration voice t-shirt and blue jeans. He is swedish...Please share his name if anybody knows....
I was the guy from Sweden. I agree with the Russian student.
The reason I was there was because my green card process was a painful and stressful experience for 5 years. And I was still one of the lucky ones! I don't want to put anyone through the same agony, not even my worst enemy. I really feel for the people still stuck in the mess.
I talked to a Polish guy who had been here 9 years fully legally and could not leave. He had not seen his family in 9 years and did not want to risk going back just in case they would not approve his H1B in his home country. They are very strict there it seems, because none of his family members or friends could not even get a tourist nor visit visa to see his graduation. Shocking!
I was glad I showed up at the rally just to hear all the peoples' stories.
Most people who did not show up probably think they are ok after applying the i485. They will join IV rallies, when they realize how wrong they are. People have applied for i485s years ago and still don't have a green card...

I was told that people on H4 are not eligible for SSN, and if I want she (the person on counter in ssa office) can issue me a denial letter for that. It sounded useless to me that time, so I didn't bother to get that letter.
This idea sounds good to me, I'll go to SSA office again and try to apply. Offcourse they will say that they can't accept application. So I'll get a denial letter and I can appeal against that.
They cannot refuse to accept your application. Fill in the forms and send them in. They can deny your application and then you can appeal. If they refuse to accept the application, you have two options. You can contact your congressman and complain. You can file a discrimination complaint with the SSA ombudsman. Here is the discrimination form.

Finally, if you believe you have been denied your rights because you are an immigrant, you can contact your local ACLU and ask them to represent your case. As a last resort, you can file a lawsuit at the federal district court. The filing fee for this is $350. However, I hope we are all doing this to exercise our rights rather than for the money. In my case, the first time I called, the person hung up on me. But I did not give up. I got them to accept the application and it is currently under reconsideration. I was also able to get a response from the Regional Office. So far they have not addressed any of the points I made in the original case as described in the OP. There has been some discussion about travel outside the US when one files for I-485. I found the official USCIS document (see the right hand side of page 4 on link below) that mentions that if you're on an "H" visa, which is the case for a lot of us, we can travel outside of the US without applying for advance parole.

I wonder... just wonder... Was the lack of any favorable items in CIR for either EB greencards or H1 B visas done with the knowledge that a week after the bills set back, all of a sudden a lot of people can apply for I485 (and hence take advantage of EAD/AP and eventually AC21 portability)...

Seems like this is just a Republican backed bill. Dems will fight this or insist that some provisions for illegals be included as well. Also once elections are over it is possible that the Dems will be majority and then this bill gets kicked to the side.

I do hope to one day vote in this country (I voted in every election in my home country after I became eligible).
If the dems do "kill the SKIL", they would have definitely lost my vote in the future. I know it is inconsequential compared to the millions they will gain from the illegals becoming legal. but in my small way, that will be my protest.

I have had all good experiences with fragoment till now, and I have been dealing with them for a couple of years now. They were very professional i should say. Again I work for one of the top 3 financial firms , and my employer has fragomen as preferred law firm.
