    When a guy comes to US for education the average age is around 23 - 24 years. MS completed by 25. Most guys at that time have burning desire to do something new and innovative (either in job or starting own business).



    And then you lose your libido :). Agreed�. With the delay you lose the golden period in your career and end up at a lower level. Most of the self made millionaires rockstarted young when they had the drive and desire. I still say America gains more than what they lose by delaying GC process. If they hand out GCs faster then who will work for those millionaires and billionaires?.

    I agree with those who say that giving green cards to the three hundred thousand wannabe immigrants will not turn the economy around tomorrow, and perhaps in the short period there doesn't seem to be an apparant advantage. After all, these are the cash cows that are milked everyday by way of taxes and the ever increasing USCIS fees.

    However, it is important to consider the larger picture with a view on the next few years. Even if a few thousand people go and buy a house, it will make a difference to the local community, however small it may be. If a few thousand people are able to start their own business, it will lead to the creation of a few more thousand jobs, which is still better than the current number - zero. Even if a few thousand decide to get a higher education, or get promoted, America will be richer in the quality of its people by those many, however small that number may be. And I bet thousands of those high skilled immigrants will demand a higher salary which which will not only level the playing field, but also result in higher pay. And need I mention the effect of higher salaries on the propensity to consume?

    I haven't even gotten into the social advantages of having a home where both parents are able to think and work freely, and the effect that has on the upbringing of their children (more than likely US citizens).

    Now, what does it really cost the US govt./America to give out the green card? As far as the issue of social security is concerned, these wannabes will be eligible anyway after 10 years, whether they have a green card or not. The USCIS fees for renewal is a about a $1000 per year, which pales in comparison to the the new car that I will buy :) What else, lawyer fees? People are worried about lawyers being displaced! You got to be kidding - immigration law is not the only kind of law practiced in this part of the world. I would be worried more for them if Americans decided not to get divorced.

    So, my question is:
    Do the costs of giving out green cards to high skilled professionals really outweigh some the benefits mentioned above?

    I don't see any good arguments for not giving out a green card sooner than later. And if there aren't any tangible benefits in keeping three hundred thousand people in limbo, then America is losing out on the advantages it will have by making them permanent residents.

    Pls excse my noob-ness, i have read all the pages of this thread but cudnt find a precise answer.
    I am in the Rn program, and wud be graduating in may08, hopefylly pass nclex and start OPT by june08. i can then start with my visa screen, and I140 as these are not retrogressed, but if retrogression continues and i am not able to file I485, do i still get an EAD. my guess is 'not' but just trying to confirm as i wud have to plan to continue with studies after 1 yr of OPT.

    There is no such thing as retrogression for I-140. Any employer can file I-140for you anytime.

    For nurses, we are Labor Certification exempt, meaning we don't have to go through this long process. Our LC process is very short, only 40 days and need not be sent to DOL. What I would suggest is that you start looking for sponsor once you're on OPT so that you can establish early priority date by filing I-140 asap.

    PD is the date you file I-140. Once your PD is current as per Department of State Visa Bulletin, then you can apply for Adjustment of Status (i-485). EAD (I-765) can accompany that AOS application.

    So, the answer to your question is NO. You cannot apply for EAD if you're applying for I-140 only. To file for EAD, it must be accompanied by I-485.

    You get 1-yr EAD though once you do your OPT and hope before it expires, your PD becomes current and you can apply for EAD based on pending I-485.

    Came here in july 1997
    filed LC in 2003 thinking it would be useful to stay on H1 as long as possible!! and the rest is on my profile..

    I wonder if anybody thinks it makes sense to create a law which simply says after 15 (or some X years) of legal presence in the US you will be given a GC no matter the back ground! In that way we know exactly where the deadline is irrespective of some government agency's whim.

    ... its just an acknowledgement of reality as it stands today.

    Of late I have started reading forums at R2ICLUB - R2ICLUB - Articles Front Page (http://www.r2iclubforums.com/) to get an idea of what it would take to go back to India. My last trip home was quite an eyeopener. Bombay has really improved a lot from what I saw last year and that much progress in a year was quite simply - amazing. I am guessing other metros in India (Delhi, B'lore, Hyd) are moving even faster since they dont have the typical politics that plagues Maharashtra.

    Am I going to pack my bags and move tomorrow? Definitely not. But I'll definitely throw feelers out and see what kind of position I can get back home.

    We pay tons of fees to USCIS

    The fee we pay is very less compare to what we pay to Attorneys. And USCIS cannot drastically increase fees. And we are stuck. That is the reality.

    I think we should cut a check of same amount what we pay to attorneys.

    Congrats: I feel better after seeing your posting. Mine too was received by R William at 7.55 on 7/2. May be it is on way too

    Thanks. It appears they are working their way through the July 2nd filers. I was getting quite nervous as my current visa expires this year and is non-renewable. If the checks had not been cashed last week, I probably would have re-filed the paperwork this week. (If my attorney thought that would be in my best interest.)

    aarbi, did you do your medicals, did you loose your work day, did you paid your attorney, did your wife(if any) came back from middle of the vacation, did you had health problem when you done your medicals....did your app got stuck at USCIS for years......
    sleepless nights for those people who's answer is YES for most of the above questions

    My wife is in the exact sme situation as yours . She to scramble around in India to get her passport re-validated after my H1 extension in the middle of her vacation and board the next flight to US , go through the medical tests only to find out that the dates have been pushed back again.

    GCTest: Is it also possible, as part of ur consultation, to see if once a person files in EB category he should NOT be allowed to marry citizen or person from current countries and thus be able to use FB etc...or other means... Or is your irritation only for EB2 category?

    Comon ppl show your talent, earn a phd and get NIW...EB1 is current :-) I will try and move up the chain. Complete my master and get to EB2 and then further complete thersis and try a NIW. That will be a worthwhile fight not what is going on.

    I-485 Processing would start depending on RD (Receipt Date). But at the time of approval PD should be current and if it is current then the applicant whose RD (Receipt Date) is oldest would get the approval first.

    I think it is time to write to Senators and Congressmen about the DREAM Act. Please see the post below that the Act is being re-introduced. It is under the thread "Alert from AILA for Dream Act Support". We should make sure that it is appplied to all children, including documented. As it last stood in CIR, the DREAM Act applied to only undocumented children.

    I am a legal skilled immigrant, came here in 1995, and am still in line for GC. My son aged-out 3 years ago, and daughter will age-out in a month. Both of them would be on path to GC and citizenship under the DREAM Act....only if they had come here as undocumented. The DREAM Act allows the benefit till age 30, whereas legal dependants age-out at 21. Why this discrimination against legal entrants?

    I am planning to send emails to as many senators as possible over the weekend.

    I think they have to be current when they get an appointment or something like that. I am pretty sure that they accounted those 18k as CP numbers


    See what I was saying. They are not supposed to grant CP appointments and approvals in July per the regulations. They have decided to bend the rules to approve the currently pending 485s and CPs. They came up with this lame excuse that since the visas were already shipped out to the consular posts ................yada yada. Point is as I said they can't do 18K CP applicatrions in a day at the consulates the way they seem to have done for the 485s. Even this I am not sure.
    I doubt whether they have sent out all 60K 485 approvals either, they probably will in the course of the next month or thereabouts.
    I'll say it again, they want 485s out but they don't want them in for whatever reason. It is getting clearer.

    This is truly sad. And I agree with WillWin that we need to do something. IV core has time and again stressed that they will not do anything for a certain EB group. I understand their stance. But every other EB group is getting help from somewhere. For EB3-I, forget getting help, we are actually losing every day forward.

    I have lost hopes now, after reading this today. This may as well be my final post to IV. I will keep my recurring payment to IV going on. Hopefully it will help my EB2 friends get their GC and help those people (refer to the Indian friends voting for lawsuit against EB3 to EB2 porting) who want to further turn the screws on EB3-I. How much can you beat a man (or a group) that is already battered?

    EB3 can only be helped when every one else is done.The way the preference categories are setup is that and the numerous cases from 2001 amnesty flooded the EB3 queue causing the retrogression. I don't suppose there can be any thing done to help EB3 specifically. We are at the bottom of the pile. If we have to be helped to get up, every one on top needs to be helped first.
    Unless the visa recapture happens, there is no hope. Folks with 2001/2002 PD , keep your spirits up. You are almost there.
    All others, if you can try EB2 porting, that's the way to go.

    Of all the wrongs in April VB +ve thing is EB3-I moved. It moved to the extent it moved last year (http://immigrationvoice.org/wiki/index.php/Past_Visa_Bulletin_Data).
    So for EB3-Is take console on these
    1) Horror or 245(i) (http://immigrationvoice.org/wiki/index.php/245(I)) are over.
    2) EB3-I may be over 2001 by start of next year.

    So EB3-I may move only by 2 months for the rest of the year?

    Not sure about which bank would be good but whichever bank you choose make sure that they give you a statement of how much interest you paid over the year. Most people don't realize that you can deduct interest paid for a home loan in India is tax deductible in the US. Just FYI.
