    All,

    My 485 was filed during the Jul 07 fiasco. My 485 online status became " fingerprinting fee has not been received and case will resume only after we get....". We even got a letter from uscis in oct 07 about this.

    However we got a letter from USCIS again in Nov 07 that it was an error on their part and asked us to ignore the letter.

    However the online staus remain the same.

    Fingerprinting was done in sep 07, got couple of EAD's and AP's as well.

    I have travelled once in AP and no issues.

    Is there anybody else with the same situation?

    Should i call the customer service and enquire?

    Please advise.

    House Republicans, fighting to remain relevant in a chamber ruled by Democrats, have increasingly seized on a parliamentary technique to alter or delay nearly a dozen pieces of legislation pushed by the majority this year.

    And an election-year promise by Democrats to pay for any new programs they created has made it easier for Republicans to trip them up.

    Tensions over the maneuvers reached a boil this week. Republicans used procedural tactics to stall floor debate for four hours Wednesday, and they are threatening to tie up future legislative action.

    The stalling tactics prompted Majority Leader Steny H. Hoyer (D-Md.) to leave the floor and meet privately in his office with Republican Leader John A. Boehner (R-Ohio) and his whip, Rep. Roy Blunt (R-Mo.). The men emerged with an uneasy detente that they said would last at least until Congress breaks for the Memorial Day recess, but the matter is far from settled.

    Since January, GOP leaders have relied on a maneuver known as the "motion to recommit" to stymie Democrats and score political points for Republicans still adjusting to life in the minority.

    The motion to recommit allows the minority a chance to amend a bill on the floor or send it back to committee, effectively killing it. In a legislative body in which the party in power controls nearly everything, it is one of the few tools the minority has to effect change.

    In the 12 years of Republican control that ended in January, Democrats passed 11 motions to recommit. Republicans have racked up the same number in just five months of this Congress.

    Democrats say any comparison is unfair because when Republicans controlled Congress, they directed their members to vote against all Democratic motions to recommit.

    Now in the majority and mindful of staying there, Democrats have given no such instruction to their members, allowing them to break with the party if they choose. Many freshmen Democrats from GOP-leaning districts find themselves voting with Republicans as a matter of survival -- a reality Republicans have seized upon.

    "Sometimes we offer motions to recommit to improve legislation -- sometimes it's to force Democrats in marginal districts to make tough choices," Boehner said. "Every time the Republicans win, it boosts morale. We're able to show unity, which is good for the overall team. Members feel good about winning on the House floor. And when you're in the minority, it doesn't happen that often."

    Democrats dismiss the Republican maneuvers as largely symbolic and so arcane as to be irrelevant to the public.

    "From a public policy standpoint, it's not very significant," said Rep. Barney Frank (D-Mass.), regarded as an expert in parliamentary combat. "It's almost a Capture the Flag game. The number of people in America who say, 'Oh my gosh, the Republicans won another motion to recommit' is very small."

    But Republicans argue they have been able to make significant changes. They point to Thursday, when they successfully used a motion to recommit to restore millions of dollars for missile defense to a defense bill. It remains to be seen if that money will survive a conference committee.

    "It's kind of a 'Rashomon' world," said Thomas Mann, a congressional scholar at the Brookings Institution, referring to the movie in which participants in an event all recount it differently. "The two parties see it in very different terms."

    The Democrats' own rules have made it easier for Republicans to offer motions to recommit. In January, the party promised to observe "pay-go" -- finding a way to pay for any new spending rather than adding to the federal deficit. The unintended consequence is that tax proposals open legislation to modifications by the minority that would not otherwise be allowed.

    Such was the case in March, when Democrats tried to pass a bill to give the District of Columbia a vote in the House. The bill included an additional seat for Utah and a minuscule tax increase to pay for two more House seats -- it called for expanding a provision of federal tax withholding law by .003 percent.

    Republicans seized on the opening and moved to recommit the bill to committee, attaching new language that would have thrown out the District's strict anti-gun laws.

    Worried that conservative, pro-gun Democrats would feel compelled to vote with GOP and kill the bill, Democratic leaders yanked it from the floor. They regrouped and split the bill into two tightly written measures, both of which passed and are pending in the Senate.

    But the problem for Democrats was apparent. "We need to address that, or we're going to be, on every bill . . . [facing] an amendment totally unrelated to the substance of the bill," Hoyer said at the time.

    This week, Democratic staffers privately discussed a rule change to limit the Republicans' ability to make motions to recommit. GOP leaders were incensed and threatened to use all available procedural techniques to block every bill except war spending legislation. But Democrats are hampered by their promise to run the chamber in a more open fashion than Republicans did when in the majority.

    Hoyer agreed to hold off on further rule changes until Memorial Day and consult Boehner and Blunt on possible changes.

    "The bottom line is, the war goes on," Mann said. "The majority uses the rules to structure debates and limit amendments on matters where Republicans have a chance to either break up the Democrats' winning coalition or embarrass them."

    Long ignored when their party was in control, moderate Republicans are the new power brokers in an increasingly bitter series of veto confrontations between President Bush and the Democratic Congress.

    Senior Democrats met last night with centrist House Republicans, trying to get a veto-proof majority for a child-health-insurance initiative opposed by Mr. Bush. Senate moderates played a part in an earlier 79-14 roll call overriding his veto of a water-resources bill. Moderates in both chambers will decide the future of a $151 billion education, labor and health-care budget approved by the House last night, 274-141, with 51 Republicans opposing the president.

    The new dynamic reflects both the Democratic takeover of Congress and how Mr. Bush responded to it. In 1994, after Republicans took over, President Clinton saw a new middle ground defined by the election and moved away from fellow liberals in Congress. Mr. Bush did the opposite, moving to the right to shore up his conservative base, leaving an opening in the center.

    The White House's more-confrontational tactics are a strategy calculated to disrupt the new majority and reduce the effectiveness of Congress to challenge Mr. Bush on the war in Iraq. The result has been a convergence of veto threats over spending levels and domestic policy, leaving little time for the two sides to reach deals.

    A stopgap bill to keep the government funded until Dec. 14 neared passage last night, and Democrats have agreed to give the president his top priority: a $471 billion Pentagon budget including emergency funds for armored vehicles in Iraq. But new fights flared up in the House over war policy, and there is no peace in sight on the domestic front.

    The education budget faces an almost certain veto. A $105.6 billion transportation and housing budget, approved by House-Senate negotiators, faces the same fate.

    The White House argues that Democrats won no mandate in 2006 to increase spending and have floundered over how best to present the bills to Mr. Bush. "Their strategy changes by the hour," White House Budget Director Jim Nussle said. "I get different answers from every one of them."

    Unaccustomed to the spotlight, Republican moderates find themselves in an uncomfortable role somewhere between being tied to the railroad tracks as the Democrats and White House come barreling down, and being the switchman who can save the train.

    Yesterday's Senate vote on the water-resources veto was the first time Mr. Bush has been overridden. The more-telling test will come on the child-health-insurance and education bills now in play.

    The health-care bill calls for an additional $35 billion in spending over the next five years to expand coverage for the children of working-class families. To win over moderates, Democrats are prepared to add tighter income limits and push more parents off the rolls. There has been a backlash from New Jersey and Rhode Island senators worried about the impact on their states; at the same time, House Republican leaders are pressing to pull their members back.

    "There's a decent chance of a deal," said Senate Finance Committee Chairman Max Baucus (D., Mont.).

    "I'm seeing the potential for some successes," said Rep. Joseph Knollenberg (R., Mich.).

    As talks continue, a synergy has developed between the fate of the child-health bill and education budget, known as the "Labor H" bill -- so much so that the health talks even moved into the House Appropriations Committee rooms last night as members voted on the floor.

    On a vote Tuesday night, it was evident that Republicans, who had stood with the president against the health-care bill, were looking for a chance to show their independence on the second bill, Labor H.

    "There was a lot of talk in the corner. 'I'm getting a lot of heat at home because of my [health-care] vote,'" said Rep. Steven LaTourette (R., Ohio). "'I have to make it right on Labor H.'"

    In crafting the package, House Appropriations Committee Chairman David Obey (D., Wis.) has moved to the right to win over Republicans. Spending has been cut by about $1 billion below the level approved by the House in July, and antiabortion language has been preserved for conservatives.

    "I've been told many times by the White House that they have no intention of compromising," he warned in a last appeal to moderates last night. "It's put up or shut up time."

    My I 485 is pending since filing in July 2007 (Receipt Date SEPT2007) Priority date in FEB2006 (EB2). I was wondering if I can change employer. I do work for client but sponsor/employer is keep on exploiting my situation, with same employer for almost 10 years now. I am really fade up. My Friend is having business and if client for whom I have been working with through my employer, ready to get new contract with Friend, then Can I change employer ? In fact relative owns business in Laundry. Is it possible , if client ready to sign contract with relative?In that case my end job is same but since through an employer who would be having different business, do not know whether it is a good idea or not ? If yes, what are limitation and demerits, time involved. Please advise.

    Folks,

    I know this may be a little of topic but just bear with me. I am simply looking at alternatives in case the GC does not pull through. Does any one over here have any experiences living and working in the Middle east ? I just read an article about Saudi Arabia's economy dealing with record unemployment. They are in the process of taking jobs away from foreigners and giving it to the locals.

    Where do we go to look for jobs in the Middle east. Any advice on this topic would be greatly appreciated. I'm praying my GC does finally pull through.

    I have appeared for interviews in toronto. They have not looked at my pay stubs in detail. The most they would go is to check if you are still employed with the same firm. Again, this said each case is different. Stuff like Employer reputation, qualification etc., surely helps.

    What will happnen to the application? will I get RFE? or should I send letter addressing the issue with copy of SSN card along with copy of receipt?

    My wife's EAD expires 10/10/08, she is currently on H4 but we filed last july and got our EAD/AP. I am planning to send her to india in May and she'll be back in November around 4th (AP expires Nov 19th).

    Please help me with info on these questions?


    1. Does she have to be in USA to apply for EAD renewal?
    2. Can she apply for EAD renewal in May (5 months in advance), I know AP cant be applied before 4 months but dont know about this EAD.
    3. Or Can EAD be applied after it expires also, if yes till howlong after it expires?
    4. Also she'll come back on 4th Nov and applies for AP immediately, is this OK if she applies before expiry date of Nov 19th but doesn't get the approval? (I know that she cant travel until she has a visa in passport or AP again)

    No that's not the case, there are stringent reqmts for proof of Date of Birth. Passport is not one of them...

    Please check other forums where this has been discussed..

    I think a passport can be used to show the birth date.

    How come a govt. organization that is never known to do things on time, all of sudden is able to approve 60000 GCs in such a short period ? Why did they have to do it by end of June ? If they had done that by end of July would anything have been different for the folks who were getting the Green Cards - NO.

    I think this was all planned. There was a reason why the numbers were made current and there is a reason why the numbers became unavailable.

    I think we should get to the bottom of this. This stinks ......

    My wife has her h4 visa stamping in a week's time. I have sent her all the documents required.
    My question is, it is mandatory for her to carry my original I-797 petition and I-129?? I have sent photo copies of both the documents, but I read some where that she has to carry originals of these 2 docs. can you pls clarify??
