I think if USCIS start publishing the number of applications (based on PD of course) pending for each month, then we can predict our future and life will be much easier.
We are not asking for too much and I think IV can make it happen fairly easily.
Any thoughts?
Thanks.

I too got the exact letter. I was annoyed to see they do not know what is the priority date. Now we know the reason for random approvals.

keep it coming guys greatwork IVBelow is the response I receieved from senetor, not sure if my email was read becuase I don't see any word about legal immigratnts in the response,
-------------------------------------------------------------------------------------
Thank you for taking the time to share your views regarding immigration. I would like to take the opportunity to respond to this important issue.
There are currently over 38 million foreign-born individuals living in the United States, which accounts for nearly 13 percent of the total U.S. population. Nearly one-third of this foreign-born population is estimated to consist of undocumented or illegal residents; a clear indication that our immigration system is broken. While a number of bills have been introduced concerning various elements of immigration reform, the issue has yet to come before the full Senate. I am currently evaluating a number of policy options, and will remain mindful of your thoughts on this subject as we proceed in the 111th Congress.
Again, thank you for taking the time to share your concerns with me regarding this issue. It is an honor and privilege to serve the people of the great State of Florida in the United States Senate. I take great pride in being a native Floridian, and I look forward to the tremendous opportunity to better the lives of all Floridians. I assure you I will work hard to represent our state to the best of my ability in the U.S. Senate. If I can be of any further help to you, please do not hesitate to contact me.

I currently have an L1 visa, and my H-1B has been approved (with the same employer). The H-1 was applied for as an initial petition. I'm going to get the H-1 stamp on December 18th this year. I'll be coming back to the states then after January 1st.
Are there any issues with a new sponsor filing to a H-1B transfer straight away after I come back? I will have pay slips with my current company, but they will mostly be from when I was on an L-1 visa. Is this an issue with this? Or is there anything else I would need to be concerned with?
Thanks in advance.

Yeah - whats with this "EnglishMEN" thing... pffftttt....
:p
Yes, wouldn't that leave out the Irishmen, Scotsmen and the hobbits et al. and ofcourse EnglishWOMEN :D
I think IV is there for Green card issues. Please refrain from saying Englishmen, chinamen etc....,
Yes, please don't do that.
but I did my bit because I could not attend. I was part of the rally that happened in San Jose.
Please try to understand the message I am conveying rather than making fun. Although I did have a hearty laugh :)
We are just having fun because, if you had seen the rally you would have noticed the diversity even though the majority was Indian or Indianmen and Indianwomen

I have gone through the text of old bill (page 265) and new bill (page 291). There is no difference b/w the two.
I believe cut off date will be Jun 19, 2007.
Please read page 286, line 40-44 and then read Section 502 d, on page 291 line 40-44.
Sigh...
This is exactly what I was thinking. I have no idea where this October 1st idea came from.

Each H1B Employer Must File a New H1B Petition

When an H1B employee wants to change employers in the United States, the prospective new employer must first file a new H1B petition. Although many people refer to this as an H1B "transfer," there is no separate transfer procedure under law. Hi Totoro,
please be so kind and explain me what exactly shall I say to the SSN Office about why I apply for SSN non-work. If they ask me to proof that I need a SSN to get Economic Stimulus Payment, what shell I do??
How is posible to get a SSN non-work to get Economic Stimulus Payment if you didn't work. How can you make tax return without to work. ?? Sorry for all this question but I really don't understand. But i'm shure that you will be very nice and you will explain me how it's work.
Thank you,
lelica
As long as you qualify for the stimulus payment, you can get a non-work SSN. You qualify as long as you are in the income levels specified, were a resident of the US in 2007 (substantial presence), and were in the US legally (have a valid visa). If you did not file a tax return, then you cannot apply for the SSN.
As far as the Social Security Act is concerned, the law states that they MUST give you a SSN if you qualify for any federally funded benefit. The question is: Is the Economic Stimulus Payment a federal funded benefit. The information in my original post makes a very strong case that it is.
Please post your experiences here, even if you are denied. Remember, the folks in the local SSA offices are bureaucrats, not lawyers, or judges, so don't expect much cooperation. However, if they deny you application, simply write them a short letter saying that you disagree and that you are requesting a "reconsideration."

This clever trick isnt going to work forever. I understand a lot of you have already spent 8-9 years here waiting for a GC, but fresh H1-Bs like me fully know what the situation is and are mentally prepared with alternative plans for career advancement. Our strategy is to save like ants while here, make mimimal investments, apply for a GC and wait. If no reform is forthcoming, we will give up on the US as a long term option and head out much before we give the prime of our working careers to a dead-end job in this country.
If a majority of the H1-Bs do that, what will the tech companies do ? They will be forced to send more jobs to our home countries. Come on, you cannot do all your work with fresh-off-the-boat H1Bs .. experience will always be needed. If they cannot get those experienced folks here, the jobs will simply go where we are (and will get done for an even lower price of course). It is already happening; retrogression will only accelerate it. Such a situation effectively amounts to training foreign workers, paying them and sending them home. It is a no-brainer who the real loser is in such a bargain : yes, it is us in the short term, but ultimately the US economy will pay a price.
Current immigration policy is based on the assumption that our home countries will forever remain poor, and the US will have a never-ending stream of smart, hard-working people desperate to settle here. In a globalized world, that is fast becoming outdated.Sooner congress realises the better.
Let us fact it. We need GCs and we have waited for x years. Now that only seems to be illusion that may happen some day, many years from now. Have we contributed to this country. Yes in many folds.
Will the US govt provide relief. Probably not. They will certainly
raise H1bs as they need more contributors to SS. All this SKIL etc is just to keep us going for a few more years. After a few more years, many will give up, but get used to living the way we live now. We just wont have the energy to complain. After a while it is human nature, at least in most cases to accept. If we accept we will continue here hoping, some day GC will happen. I believe the majority will fall into this category. There maybe a few who will leave. But then there will be thousand more new H1b coming in to do the work, chasing the GC illusion, contributing to SS, buying cars, paying rents keeping the economy going. The lawyers will make money. Employers will get indentured workers. The economy will benefit from their productivity. So all concerned except you and me will be OK.
They understand the circle of life better than you and I do. It is about time we understand this. Once this sinks in, we will make the right choice, whet ever that maybe.

Thank you qasleuth. I did not even read the whole thread but this thread needs to be closed and some action needs to be taken against anti-IV elements.
Folks, IV is a platform to come and work on the common goal. It is not a platform to come and abuse it by blaming it just because you do not have a green card till now. Come join us and help out. Be an active volunteer and work on daily basis with us to solve the problem and make IV better. We need more real workers on the ground than strategy advisers, critics and Management consultants.
Enough said. Actions will speak louder than words and you need to get involved to tell us your ideas. If you are interested to actively participate send us an email (info at immigrationvoice.org) with your valid email address with your name, phone number and what you would like to do to help IV. We will welcome your active participation and assign you leadership roles if you want.

if Obama wins:
+ its better for the world in general. The last thing we want is more of GWB policies destroying both America's economy, civil rights, and respect in the world.
- his best friend Durbin will again pick up the stick and start beating up on H1 sponsoring. EB will also get run over by the same bus.
- FB immigration will be put in preference over EB, we are screwed.
if McSame wins:
+ my taxes remain low
- CIR is back. 13 millions illegals will get in line. points based system for EB immigration and we are all screwed again.
- if McCain does not live through his presidency, the biggest country and economy in the world, with the largest number of nuclear weapons, the largest amount of military spending... the rome of our time, with nearly unlimited power and presence around teh world, will be run by a mayor of a small town. Rember her trying to get her brother-in-law police officer fired during her sisters divorce? And when the administrator refused her requests, he fired him? Remember how she emails people off-the-record from her Yahoo account? Remember how she CC's her husband on official emails? Do you want someone that stupid, who already abused whatever little powers a mayor and governor has, to be the commander-in-chief of the united states armed forces?
Either way immigration-wise we are screwed. I think for the sake of the rest of the world we must wish that this time McCain loses this election. He has made a very stupid VP choice.
Obama is no panacea either. Why do you think someone with little experience is a liability to be second in command, but the same lack of experience is admirable quality for the first in command.
Also, Obama has been changing his positions on issues to pander to the voters, I doubt he will be any different from Bush either. The only change you are going to see is in himself -- not the way things are done. He will probably pay more of the tax monies to people who gambled with their houses (and are still not being punished for it).

Yes that is true. They are lobbying strongly for H1b though they are supporting GC increases. Actually with H1b you can stay unlimited years if you apply gc. So there is no urgency for corporations to resolve the issue. They do not have fear of losing you as you are going to stay in USA until you get green card
You are right, but they do have some or may be a little more interest in the GC process too.
1) Because they are paying a lot of money to these consultant companies which they want to reduce.
2)Come to wall street, you will see so many consultants that are needed here to keep this economy running. A high number of H1-B will definitly reduce the price but still they will not get what they want meaning a permanent employee on a lesser pay. Tech companies cannot hire a person permanently because he is stuck with his employer who has filed his GC.
The companies cant continue to pay a lot to these consultanting companies.
Secondly this country should attract good brains, who might not want to come here. Believe me my friends in india are happy there and do not want to come here. They are living in there own homes with families, enjoying every part of our indian culture and are happy.
If nothing really works out here I will be looking out for an oppurtunity back home.
