So many posts, so many links have been done on this. One of the main reasons, eb3 is so backlogged is this legal and greedy snatching of unused HB3 visas from 200 to 2005.
I see point and counter-point, but no action yet.
Where did the 50K visas come from? Where will the 90K visas come from?
Are they from the total pool of 144K/year or is this an additional amount (144K + 90K) allocated for health care?
Who is included in health care? Thanks.

I was reading the posts, I somehow believe there are some variations among EB2 categories, of what we all have been calling I,II or three.
It is not not primarily based on salary only, I believe, it has more to do with the nature of your job, job title, size of the company, type of company, for profit or non-profit.
My wife is a University professor, applied for our GC, EB2 India PD date august2007. We got our labor approved in a less that 2 months, we got our I40 cleared in 5 months, ( applied in January 08 got approved in June).
I believe , we are able to move so fast in this process was mainly because the type of company she works for, in this case the non profit institution.
Now at this point in time, I would like to ask all the gurus, are the dates going to move fast in next few months?

similar incident happened to my room-mate, may be little worse.
The airline was aerofloat (russian) in this case.
they boarded aircraft from bombay to ewr. aircraft started running on runway and after some unsuccessful attempts they came back to terminal. with everyone's surprise, the pilot announced that there is a techincal difficulty and unable to takeoff.
Next flight was after 48 hours and that too from delhi. No need to say my friend spend 24 hours also at moscow airport and finally reached newark after 4 days finally. All these with no ground staff at bombay by aerofloat. Being young students, my friend and his groups helped like a coolie to shuttle all other elderly passengers bags to hotel and so forth. He is a very fair person and still doesn't blame aerofloat. He bought the return ticket for 760 with tax, where other airlines used to charge like 1200 or so.
morale of the story: don't blame airindia for all the faults. I am sure there is lot to improve but it is not the only airline where things go bad. This is possible anywhere.
and lastly, the OP who blamed airindia for not allowing duty free stuff bought at NJ at frankfurt - don't blame AI. It is the airport staff of FRA and not AI.
For all those who think that only airindia is bad, go to google and search for reviews of any airline. Chances are very high that you will get such horror stories described by someone.
The OP somewhere has an attitude that he is too important and shouldn't have any issues. Unfortunately the world is not perfect.

I think there is a general consensus that H-1B program is being abused by employers. IEEE is suggesting to wrap it up while others are suggesting to keep the program but fix it, by providing the flexibility based on the current market needs and enforcing tough monitoring on the employers.
I must agree that the document is a perfect representation of how the H-1B program is being abused, which is unfortunate!

No doubt if you have the time, money and opportunity and if you plan to do your masters or your second masters at some point in future, then right now is the time to do it while you are waiting for your GC.
However, you have to be luck to be able to do that as a way to spend the retrogression years constructively.
1. You should have the money to study and maintain yourself/family.
2. Need to have school of decent choice where you live.
3. Need to have a job at same location. Consultants cant have that as they move around from one project to another. You cant change colleges and transfer credits every 6 months as you move from one project to another. Same goes for consultants who are travelling all the time. They cannot do this unless to quit and go fulltime, in which case, the spouse would have to start working to pay the bills and put food on the table.
And what about people who DONT want to do MBA/MS and just want to change employers?
So while a good option, it applies to very few people. If you are one of those few guys, then by all means, go for it.

H1 doesnt work as you are interpreting. OP was working for 'A' and had a valid H1. At some point of time, he got a job offer from X and had his H1 transferred to X. Even though his new H1 is approved, his old H1 is still valid. It is valid as long as OP doesnt join X. Since the OP never left A and never joined X, he was always in status. OP -> this should be a simple case. Since you have documentation to prove that you were in status always and since you never joined X , you dont have paystubs and that should be perfectly fine as long as you never left A.

1. Let us decide how we need the data. ie what query USCIS has to run
2 make publicity of this .. ie uscis is an agency which should have the data but it is asking us to pay 5K for the data. (president, hillary clinton, aila and whoever else,...)
3 Only getting this data one time wont help us. Like USCIS processing dates , they have to run our query every month on a particular date and publsh it. Otherwise after 6 months or one year we have to pay this money again.
4 Can we appeal to the money asked by USCIS. Anyone who knows more about FOIA
5 Can we request USCIS to give us the table details and tell them we can write the query/program free of cost.
Any other suggestions..

Agree with you 100%. Instead of 'forming' state chapters in the last moment, they need to be established, nourished, strengthened and developed over a period of time. A grassroots movement needs strong roots in all regions.
With all due respect, it was a disaster. They ended up scaring Americans - by holding Flags of thier countries, holding US flag upside-down or disrespecting US flag in other ways. This provided fodder to anti-immigrants to scare Americans of an 'invasion' of law-breaking aliens.

Do you really think the numbers will be that bad? Look at the improvement in turnout in DC from San Jose? Every movement political or not builds gradually. The idea is to make it easy for people to show up rather than ridicule them for not showing up.
We asked people to show up at the rally giving up (1) A day�s pay ($400 to 1000) (2) Spend money on travel where ever the buses were not available ($$) (3) Spend time away from home. That�s a little difficult for people who have not seen a single person from IV yet (which is most of us). On the other hand many people who attended the rally in San Jose did not mind traveling all the way to DC�Can you think why? Do you think Indian�s in CA have a different mindset compared to those in TX or NY/NJ?
IMHO, we need to do more work at grass root level. If rallies are local and on a weekend then more people will turn out. Not only will there be better turnout, many of these same people will being more passionate about their support to IV and might start showing up in out of state rallies and protests.
Many of my colleagues did not even know until yesterday when I showed then the news articles that there was a rally like this in DC. Unless we have local chapters with an organized structure which meet regularly/ even if it�s a conference call, you cannot expect mass mobilization�this is Politics works!!
I think the DC rally has caught every ones attention, this is the right time to push the drive for local mobilization, it will be tragic if we lose the momentum now.

Interesting points. I have a question. When changing employers, after 180-day portability period, do we need to use the EAD or can the new employer file a new H-1B petition on your behalf essentially keeping your non-immigrant status valid at the same time your I-485 applied through your previous employer is still pending. Thanks.

Here are just a few that I can think of rightaway.
1. Once shifted to EAD you loose opportunity to renew or apply for a new H1B if you have not completed six years though.
2. You have to apply for EAD renewal every year and much in advance. H1Bs are issues for 3 year periods.
3. Suppose there is a delay in getting the renewal, you are NOT allowed to work until the renewal comes through. Renewal duration depends on the work load.
4. Fee of EAD is being hiked to $340 per year.
5. Couple of my EAD starting date was the approval date even though the current EAD had not exipred effectively loosing couple of months validity each time.
6. Due to some issues if I-485 gets revoked the EAD/AP are invalidated the very next moment and you accumulate illegal stay and would not have time to get the process going.
On the other hand having a H1B you can apply for EAD any time or not even apply if you have sufficient validity on it. Suppose the I-485 gets rejected you can reapply for a new one or from an another employer and still work/live legally in the US.
EAD allows you to work any type/number of jobs that is the big PLUS though!

Kartik, as long as we, the EB3 do not come forward and collect huge amount for lobbying, we will continue to lurk here for many more years.
Unfortunately the sad part is, whatever lobbying is done actually helped only EB2 I, may be due to a wrong notion by USCIS that all Hi-tech immigrants are EB2. This could be a fact as there are thousands of 245 cases that fell into EB3.
Another bad thing was that USCIS release this VB yesterday which means one extra day to CRY.
I do not blame any one, but ourselves. We do not want to spend money and hence dying in this process. No solution, but cry at every VB day.
