I am currently starting a language institute in California. I incorporated the organization 2 years ago, but I am starting it now. I want to hire a Brazilian national on an h2b visa to teach Portuguese but I am worried that as I am starting the business now and haven't generated income yet I won't be allowed to hire this teacher. Is this something I should worry about? Thank you for any help. I appreciate it.

From Public Policy Polling: Our poll of the Texas Governor's race this week is another data point indicating possible backlash for Republican candidates this fall in the wake of the Arizona immigration law. Hello Friends
My husband was an employee of a desi company and they had withheld part of his salary, he filed a complaint at the DOL and got the pending money back.. that was 4 years back.. now he is trying to change his job and the new employer wants to do his background check..
what will show up in his background check? will the case against his employer affect him? we are really worried about this.

don't think their is a set time required. I know people that left their employer the day after gc arrived, know people that left 6 months after their approval and some that have worked for their employer even after receiving their green card for over 4 years. hope this helps

If H1B extension gets denied and my employer will appeal it. My questions are
1. Can I allowed to work until I decision is made on appeal?
2. If appeal is denied, from when I will be consider as out of status? (from I-94 expiry date or appeal decision date)
3. After appeal denial what is the grace period to leave the US?
4. Can same employer is allow to file another H1 petition for me?

After we have filed for 485 and lets say we (me and my spouse) receive our EAD's. If I quit my job after 6 months of filing, can my spouse (secondary applicant) continue to renew her EAD's or would she have problems since I (the primary applicant) is no longer working for the company and maybe working for myself?

Spouse I-485 Receipt Notice.
Applied I-485 for my wife in the first week of September (8th Sept) when the dates became current, but haven't received the receipt
number yet.
I got an RFE (EVL) on my application which I submitted on 21 Sept. USCIS received the response on 22nd Sept and updated the case.
I am little worried that whether USCIS has received her application or not. Is there a way to find out, whether I can open an Service request or take an Info Pass regarding this?
Any suggestions will be helpful.

I recently got an RFE for my I 485 Application.
Need to prove my non-immigration status from Nov 29 2007 to Nov 24 2008 .
I have I-797 ( H1-B approval ) for the above mentioned period. But My Last Name in the approval has a typo error ( in place of letter A they misstyped U). My Enployer has opened a Service request to correct the Name in H1 B approval. But he is saying that he never got the corrected approval. Time went by and i applied for H1 ext..i got the H1 extension from Nov 25 2008 to Nov 2011.
So My question is
Is it okay to submit all the documention that was sent to USCIS to correct the name along with the I 797,I-94 for the above mentioned period and explain them that we did not recieved the corrected I-797 ? or not
Please suggest me ..

Each year, the U.S. government makes 65,000 H-1B visas available to qualified individuals on a first-come basis. The cap has been reached every year for the last several years, and for fiscal year 2008, it was reached on the first day of filing. Q. Will the payment I receive in 2008 reduce my 2008 refund or increase the amount I owe for 2008?
A. No, the Stimulus Payment will not reduce your refund or increase the amount you owe when you file your 2008 return.

As suggested by pappu/starsun, this supporting thread provides impacted members with additional information and tools to help the initiative.

As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.
