Does anyone know if EAD renewal requires an employment at the time of renewal? My I140 have been approved and I485 pending for long time under EB2-NIW. Also, do I loose legal status to stay in USA if I lost employment while my I485 pending. Again, my GC application is not company sponsored, it was all by myself. Do I stay in right status even I become unemployed while my I485 pending. My I485 will be pending for few more years due to retrogession. So I am wondering if I can stay as unemployed for a period of time while my AOS pending.
Also, do I need to have an employment while re-entering using AP? I recently used my EP to re-enter but no question was asked about employment. I am thinking if I can use AP for re-entry if I travel outside while I am unemployed. I have to think about all this options as chaotic situation is going on the company and layoff might be inevitable.

I just filed for an H1B transfer in April. My current H1 is valid till April 2010. Just got an email from CRIS stating that my current I-129 case which was approved in April 2007 has been reopened at USCIS determination for review. Is there a problem or is it just normal procedure to look at the original H1B petition? Have transfered H1B before but have never had this happen. Is this something new that they are doing? Incidentally I am on the 10th year of my H1B and have a copy of the approved I-140 based on which we filed for a 3 year extension.

My I-485 is pending with PD of Oct 11 2006(EB2 India). I have been on H1 as was not able to add my spouse to my initial 485 application. As my H1 expires on Sep 6, we recently filed for H1/4 extension and received an RFE for Employee-Employer relationship. We have to answer this by Sep 13. As a Plan B, What we did in June 2010 was
a) I filed for my EAD
b) My spouse got admitted into a school here and applied for COS from H4 to F1 with a valid I-20.
Both of these cases are currently pending.. My questions are:
1) As our H1/4 and I-94 expires on Sep 6, Would we still be in legal status after Sep 6 as both of our cases (EAD and COS) are pending?
2) After answering the RFE, if it is denied, would it impact my GC processing?
3) I understand that even if my H1 is denied, As I have a pending EAD, my status would be okay but what options would we have if my Wife's case is denied.

I filed my 485 on June 4th 2007 with NSC. It was transferred to TSC and received my Receipt notice. Now I am going to file my AP.
My question is where should I file my AP?. Do I need to file with NSC or TSC?.
Please someone respond.

The New York Times carried on its front page this morning a Nina Bernstein article that will no doubt cause a shake up at Immigration and Customs Enforcement over what can only be described as a major scandal in the way the agency has dealt with sick detainees at the agency's detention facilities around the country. The details described by Bernstein will no doubt enrage you. Do priority dates matter now?
with the deluge of applications that will be filed,will the priority dates matter anymore?
lets say someone with a priority date of Dec 2006 (EB2-ROW) applied for 485 in Feb 2007...will his case be processed before a person with a September 2005 priority date that filed in July 2007 (EB2-India)?
so other than allowing us to file the 485 the priority date has no value?

The couple applied for the green card together. The husband applied under the EB1 category and his wife also applied with him as dependent. The green card of the couple has been approved and is expected to arrive in a month's time. The wife is not in US currently. She is outside US. Will the husband get his green card & the wife's green card in his wife's absence? Will there be any complications in the husband's green card in this case?
